Magna 5 Pick 5® Pools
Official Rules and Regulations

  1. The Magna 5 Pick 5™ (“Magna 5™”) is a Pick 5 wager which requires selection of the first-place finisher in each of five races held on the same day at one or more racetracks owned and/or operated by Magna Entertainment Corp. (“MEC”). Participating racetracks and races comprising a given Magna 5 contest will be selected from time to time by MEC in its sole discretion.
  2. The minimum amount for a Magna 5 wager is one dollar ($1.00).
  3. The pool for a Magna 5 contest shall be canceled and all Magna 5 wagers for that contest shall be refunded if at least two races included as part of that contest are canceled or declared "no contest."
  4. When the condition of the turf course warrants a change of racing surface in any of the races constituting a given Magna 5 contest, and such change has not been made known to the betting public prior to the close of wagering for such contest, the stewards shall declare the changed race(s) a “no contest” for such contest, and the pool for such contest shall be distributed in accordance with section 3 or 5 of these rules and regulations.
  5. If one race included as part of a given Magna 5 contest is canceled or declared "no contest", the net pool for such contest only shall be distributed, on a pari-mutuel basis, among the bets which contain the most correct selections for the races which are run in that contest. Such distribution shall include the portion ordinarily carried over from wagering on that specific Magna 5 contest but shall not include the carryover from pools from previous Magna 5 contests.
  6. Except as provided in section 3 or 5 of these rules and regulations, the net pool created under a given Magna 5 contest, along with carryover from pools from previous Magna 5 contests, if any, shall be distributed on a pari-mutuel basis among those bets which contain:
    1. all the correct selections; or
    2. the most correct selections if:
      1. no bet contains all the correct selections; and
      2. MEC has given prior notice that there will be a mandatory distribution of the carryover.
  7. If no bet contains all the correct selections in accordance with subsection 6(a) above, and subsection 6(b) of these rules and regulations has not been invoked by MEC having given prior notice that there will be a mandatory distribution of the carryover, the net pool created under a given Magna 5 contest shall be divided into three pools, where:
    1. 25% of the amount bet into such pool on that Magna 5 contest shall be distributed among those bets which contain the most correct selections;
    2. 75% of the amount bet into such pool on that Magna 5 contest shall be carried over to the next Magna 5 contest; and
    3. 100% of the carryover from pools from previous Magna 5 contests shall be carried over to the next Magna 5 contest.
  8. If there is a dead heat for first in any of the Magna 5 contests involving:
    1. horses representing the same betting interest, the pool for that Magna 5 contest shall be distributed as if no dead heat occurred; or
    2. horses representing two or more betting interests, the pool for that Magna 5 contest shall be distributed, on a pari-mutuel basis, as if all horses in the dead heat for first are considered winning horses in the race for the purpose of calculating the will pay from that pool (taking into account any horses that might represent the same betting interest if there is a dead heat among more than two horses).
  9. If there is more than one combination of winning bets, the aggregate dollars wagered on the winning combinations shall be used to calculate the will pay.
  10. If a betting interest is scratched, excused or determined by the judges to be a non-starter:
    1. the actual favorite, as evidenced by the amounts wagered in the win pool for the race in which the scratched betting interest was to participate is closed, shall be substituted for that scratched betting interest; or
    2. the favorite with the lowest program number shall be substituted for the scratched betting interest if the amounts wagered in the win pool are identical on two or more favorites when wagering on the race is closed.
    The totalisator shall produce reports showing each of the wagering combinations with substituted betting interests which became winners as a result of the substitution, in addition to the normal winning combination.
  11. With the exception of the total amount of the net pool at the close of a given Magna 5 contests wagering, the totalisator shall be programmed to suppress all information related to Magna 5 contest wagering activity until the conclusion of the final race comprising that contest. Providing information to any person regarding covered combinations, amounts wagered on specific combinations, number of tickets sold or number of live tickets remaining is strictly prohibited. However, the foregoing shall not prohibit necessary communication between totalisator and pari-mutuel department employees for processing of pool data.
  12. No pari-mutuel ticket for a given Magna 5 contests pool shall be sold, exchanged or canceled after the time of the closing of wagering in the first of the races comprising that contest, except for refunds on tickets for that contest as required by these rules and regulations.
  13. MEC may suspend previously approved Magna 5 contest wagering with the prior approval of the Maryland Racing Commission. Any carryover shall be held until the suspended Magna 5 contest wagering is reinstated.
  14. Magna 5 is offered only in the United States, Canada, Germany, Austria, Spain, Great Britain (in each case where legal) and is open only to legal residents (of such jurisdictions where Magna 5 is lawfully offered) who have reached the age of majority in their resident state or province.
  15. These are the official rules. Magna 5 is subject to all applicable Federal State and Provincial law. These rules are subject to change without notice in order to comply with any applicable Federal State or Provincial laws.
  16. Liability for any and all Federal, State, Provincial and local taxes rests solely with the prize winner.
  17. MEC assumes no liability for typographical or other errors in the offer or administration of Magna 5 including, without limitation, errors in the printing of the offer and official rules, selection, notification and announcement of the winners, or distribution of the prizes.
    MEC, its subsidiaries, affiliates and each of their respective directors, officers, employees and agents shall assume no liability of any kind whatsoever in any cases in which their inability to act results from an event or situation beyond their control, including, but not limited to Acts of God, civil or military authority, acts of public enemy, war, riot, civil disturbance, fire, explosion, earthquake, flood, strike, third party non-performance lockout, labor disturbance, or any other cause beyond the control of a party. In such event, MEC reserves the right to modify, suspend, or terminate Magna 5. No responsibility is assumed by MEC for late, lost, misdirected, damaged, incomplete, illegible registration submissions/phone calls/wagers, postage due mail, disconnected, inaudible, interrupted phone calls, any computer, telephone, cable, satellite, network, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, service provider/Internet/web site/use net accessibility or availability, traffic congestion or unauthorized human intervention. MEC reserves the right, in its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of Magna 5; or to be acting in violation of these Official Rules. MEC is not responsible for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in Magna 5 and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site.
  18. If, for any reason, the on-line and/or telephone component of Magna 5 is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which MEC in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of the on-line and/or telephone components of Magna 5, MEC reserves the right at its sole discretion to cancel, modify or suspend the on-line and/or telephone components of Magna 5. In such event, notice will be posted at www.magna5.com.
